Abstract

RÉSUMÉ:

Cet article analyse le caractère non-dérogeable des droits prévus par la Charte africaine des droits de l’homme et des peuples dans le contexte d’urgence sanitaire due à la pandémie de Covid-19. Il part du constat selon lequel le système africain des droits de l’homme consacre un standard élevé de protection des droits de l’homme comparativement aux autres standards régionaux et international du fait de l’impossibilité de déroger aux droits garantis quelle que soit la circonstance exceptionnelle. Cependant, maintenir un tel standard s’est avéré incompatible avec la nécessité d’endiguer la Covid-19. D’abord, la déclaration dans plusieurs Etats africains de l’état d’urgence sanitaire, dérogatoire aux droits de l’homme, viole la Charte africaine. Il en découle dès lors que de nombreuses mesures adoptées à cet égard annihilent certains droits garantis par la Charte tout en renforçant certains autres. Enfin, la justiciabilité de ces mesures devant les organes de mise en œuvre de la Charte reste hypothétique au regard de rapports complexes entre ces organes et les Etats. Pour renforcer à l’avenir l’efficacité du système africain de protection des droits de l’homme en cas d’urgence sanitaire, cette étude plaide en faveur de l’adoption d’une convention régionale applicable aux situations d’urgence pour un maximum de sécurité juridique face aux décisions étatiques susceptibles de rendre dérisoires les droits protégés par la Charte.

 

TITLE AND ABSTRACT IN ENGLISH: The African human rights system and Covid-19 induced states of emergency

Abstract: This article examines the non-derogable nature of the rights guaranteed in the African Charter on Human and Peoples’ Rights in the context of health emergency situations induced by the Covid-19 pandemic. It is premised on the understanding that the African human rights system provides a high standard for the protection of

human rights as compared to other regional and international standards due to the impossibility of derogating from the rights guaranteed irrespective of the circumstances. However, maintaining such a standard has proved incompatible with the need to contain Covid-19. First, the fact that several African states declared a state of health emergency, which included derogation from human rights, violates the African Charter. As a result, several measures taken on this occasion annihilate some rights while strengthening others. Finally, the justiciability of these measures before the bodies which oversee the implementation of the Charter remains hypothetical in view of the complex relations between these bodies and states. To strengthen the effectiveness of the African human rights system in future situations of health emergency, this article advocates for the adoption of a regional treaty applicable to emergency situations for the highest level of legal certainty in the face of government decisions likely to make the rights in the Charter illusory.
